
Felony charges against Malcolm Roach Sr., a former candidate for the Smith River District seat on the Patrick County Board of Supervisors, have been dismissed.
Patrick County Commonwealth’s Attorney Dayna Bobbitt said Roach’s attorney filed a motion to suppress evidence obtained from his personal computer, arguing that one of the search warrants contained an error.
“Following a hearing on July 1, Judge (G. Carter) Greer ruled that the search and seizure of Roach’s personal computer was invalid. As a result, all evidence recovered from the computer was suppressed. Without that evidence, the Commonwealth was unable to proceed with the prosecution, and the charge was dismissed,” Bobbitt said.
Roach was arrested June 9, 2025, on 10 felony counts of attempting to possess bestiality materials.
Roach has sold his property in Patrick County and moved out of state.
